Terms of Use
These terms apply to your use of the prostir zvuku app and website. By downloading, installing, purchasing, or using prostir zvuku, you agree to them.
Who we are
prostir zvuku is an independent app for building spatial nature soundscapes on Mac and iPhone. When these terms say "we", "us", or "our", they mean the developer and operator of prostir zvuku. Contact: [email protected].
Apple and purchases
prostir zvuku is distributed through the Apple App Store. Your download, purchase, refund request, and use of Apple services may also be governed by Apple's terms and policies.
The app
prostir zvuku lets you build and play spatial nature soundscapes using a bundled sound library, a spatial canvas, presets, timer, background controls on Mac and iPhone, optional iCloud sync of room data between your own devices, and optional head tracking with supported AirPods.
License
Subject to your compliance with these terms, we grant you a limited, personal, non-exclusive, non-transferable license to install and use prostir zvuku on Apple-branded devices that you own or control, as permitted by the App Store usage rules and applicable Apple terms. The app is licensed, not sold.
You may not:
- decompile, reverse engineer, or attempt to derive the source code of the app, except where local law expressly permits;
- redistribute, sell, sublicense, or rent the app or the bundled sound library;
- extract, copy, export, or reuse the bundled sound files outside prostir zvuku;
- remove or alter copyright, attribution, or trademark notices.
Your presets
Presets, sound positions, timer choices, and other configurations you create in the app are yours. We do not claim ownership of them.
Our content
The app, website, brand, interface, code, artwork, animations, text, and bundled sound library are owned by us or licensed to us. Except for the limited license above, we and our licensors reserve all rights in prostir zvuku and its content.
Free version and lifetime unlock
The app may include a free version and an optional one-time lifetime unlock. "Lifetime" means access to the paid functionality of the current prostir zvuku app for as long as we continue to offer and support that app. It does not guarantee access to separate future products or services.
Purchases, restore, and refunds
In-App Purchases are processed by Apple through StoreKit. The app includes a restore mechanism for restorable purchases. If you reinstall the app or move to another supported device using the same Apple Account, use "Restore Purchases" in the app where available.
Refund requests for App Store purchases are handled by Apple under Apple's rules. We cannot directly issue App Store refunds.
Updates and changes
We may add, change, or remove app features, presets, sounds, interface elements, platform requirements, or website content. We may also stop supporting older app versions or older platform versions where needed for security, compatibility, App Store requirements, or product quality.
Acceptable use
You agree not to use prostir zvuku:
- in violation of applicable law;
- to infringe, misappropriate, or violate anyone's rights;
- to interfere with, abuse, or attempt to compromise the app, website, App Store, or related systems;
- in a way that could damage, disable, overload, or impair our services or providers.
Health and safety
prostir zvuku is a relaxation and productivity tool. It is not a medical device, alarm system, or emergency service. You are responsible for using safe listening volumes and for using the app in appropriate environments.
No warranty
The app and website are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, secure, compatible with every device or audio output, or compatible with future versions of macOS or iOS.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app or the website. Our aggregate liability for any direct damages will not exceed EUR 100 or the amount you paid for the app in the twelve months preceding the claim, whichever is greater.
Termination
You may stop using prostir zvuku at any time. We may suspend or terminate your license if you violate these terms. On termination, you must stop using the app and delete any unauthorized copies. Sections that by their nature should survive termination will continue to apply, including intellectual property, purchase terms, disclaimers, limitation of liability, and governing law.
Changes to these terms
We may update these terms as the product, App Store requirements, or law changes. The "last updated" date shows when these terms were last revised. Continued use of the app or website after an update means you accept the updated terms.
Governing law
These terms are governed by the laws of Ukraine, except where mandatory consumer protection law says otherwise.
